Standard Operating Conditions — Version 2.1
1. Formation of Contract
A contract is established once a Quotation is accepted via written confirmation or upon the arrival of a Zenda Logistics vehicle at the loading point. These terms override any client-issued purchase order terms unless expressly signed by a Zenda Director.
2. Loading & Demurrage
The Client is responsible for the safe and efficient loading/unloading of cargo. Zenda Logistics allows a 3-hour window for loading and a 3-hour window for offloading.
3. Limitation of Liability
While Zenda Logistics maintains comprehensive Goods-In-Transit (GIT) insurance, our maximum liability is capped at the value declared at the time of booking. We are not liable for indirect or consequential losses, including loss of profit or business interruption.
Notice of Claim
Any visible damage or shortage must be noted on the Proof of Delivery (POD) document immediately upon offloading. Formal written claims for damage or loss must be submitted to Zenda Logistics within 48 hours of delivery. Claims made after this window will be void.
These terms are governed by the Laws of the Republic of Kenya. Jurisdiction: Nairobi.
